Terms of Service

The rules for using Embeditor.

First draft for review. Confirm legal entity, governing law, dispute venue, billing terms, support commitments, SLA, and enterprise order-form language before publishing.

These Terms of Service govern access to and use of Embeditor's website, app, APIs, embeddable editor, experimentation tools, analytics, AI features, and related services.

By creating an account, installing the Embeditor script, using the service, or clicking to accept these Terms, you agree to these Terms on behalf of yourself and, if applicable, the company or organization you represent.

1. Definitions

  • "Embeditor" means the Embeditor product and the company or legal entity that provides it.
  • "Customer" means the person or organization that creates an account, installs the script, or uses the service.
  • "Customer Content" means websites, page content, prompts, instructions, edits, variations, checkpoints, analytics configurations, and other material submitted to or processed through the service.
  • "Visitor Data" means pseudonymous analytics, exposure, session, event, conversion, and technical data collected from visitors to a customer website where Embeditor is installed.

2. Accounts and authority

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account and for anyone you invite to your workspace.

If you use Embeditor for an organization, you represent that you have authority to bind that organization to these Terms.

3. The service

Embeditor lets customers edit page content, create and publish variations, track checkpoints, view analytics, and use AI-assisted editing. Embeditor may change, improve, suspend, or discontinue parts of the service from time to time.

Some features may be beta, experimental, or in preview. Beta features are provided as-is and may change or be withdrawn at any time.

4. Customer websites and embedded script

  • You are responsible for the websites where you install Embeditor and for having the rights needed to modify those websites.
  • You are responsible for testing variations before publishing and for monitoring the effects of edits on your website, brand, accessibility, SEO, legal claims, and user experience.
  • You must provide legally required privacy notices, cookie notices, consent mechanisms, and opt-outs to visitors before using Embeditor for analytics, experiments, or conversion tracking.
  • You must not use Embeditor to collect sensitive, regulated, or children's data unless Embeditor has expressly agreed in writing.
  • You must not use Embeditor in a way that harms website visitors, misleads users, interferes with security, or violates laws or platform rules.

5. AI features

AI features may generate suggestions, code, copy, layout changes, or operations based on your prompts and selected page context. AI output may be inaccurate, incomplete, infringing, unsafe, or unsuitable for your use case.

You are responsible for reviewing, approving, testing, and publishing AI-assisted edits. Embeditor does not guarantee that AI output will improve conversions, comply with laws, or avoid third-party rights.

6. Acceptable use

  • Do not violate laws, privacy rights, intellectual property rights, or contractual obligations.
  • Do not upload malware, attempt unauthorized access, probe systems, bypass rate limits, or interfere with the service.
  • Do not use the service to create deceptive, discriminatory, harmful, abusive, or illegal website experiences.
  • Do not use the service to collect payment card data, government identifiers, health information, children's information, or other sensitive data without written approval.
  • Do not reverse engineer, scrape, resell, or provide the service to third parties except as permitted by these Terms or a written agreement.

7. Customer Content and ownership

As between you and Embeditor, you retain ownership of Customer Content. You grant Embeditor a limited license to host, process, transmit, display, modify, and otherwise use Customer Content as necessary to provide, secure, support, and improve the service and as otherwise permitted by these Terms and the Privacy Policy.

Embeditor owns the service, software, documentation, designs, models, workflows, and technology. Except for the rights expressly granted, no rights are transferred.

8. Feedback

If you give feedback or suggestions, Embeditor may use them without restriction or compensation, but we will not publicly identify you as the source without permission.

9. Data protection

The Privacy Policy explains how Embeditor handles information. For Visitor Data processed on a customer website, the customer is the business or controller and Embeditor acts as service provider or processor unless a separate agreement says otherwise.

If privacy law requires a data processing agreement, the parties should enter into Embeditor's data processing addendum before using the service for regulated personal data.

10. Third-party services

The service may depend on or integrate with third-party services such as hosting, database, authentication, email, AI providers, form tools, analytics tools, and customer websites. Embeditor is not responsible for third-party services, and your use of them may be governed by separate terms.

11. Fees and subscriptions

Paid plans, if enabled, will be described at checkout, in an order form, or in a separate agreement. Fees are due as stated at purchase. Unless the checkout or order form says otherwise, subscriptions renew automatically until canceled.

Before publishing, Embeditor should insert the exact billing provider, refund policy, cancellation flow, renewal notice requirements, tax language, trial language, and any plan limits.

12. Confidentiality

Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only to perform under these Terms, except where disclosure is required by law.

13. Suspension and termination

You may stop using the service at any time. Embeditor may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay fees, or use the service in a way that could harm Embeditor, customers, visitors, or third parties.

After termination, your right to use the service ends. Certain sections, including ownership, payment obligations, confidentiality, disclaimers, limitations of liability, indemnity, and dispute terms, survive termination.

14. Disclaimers

The service is provided as-is and as-available. To the fullest extent permitted by law, Embeditor disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, and any guarantee of conversion lift, revenue, traffic, or business results.

15. Limitation of liability

To the fullest extent permitted by law, Embeditor will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or cost of substitute services.

To the fullest extent permitted by law, Embeditor's total liability for all claims relating to the service will not exceed the greater of the amounts paid by the customer to Embeditor for the service in the 12 months before the claim or USD $100.

16. Indemnity

You will defend, indemnify, and hold harmless Embeditor from claims, damages, liabilities, costs, and expenses arising from Customer Content, your websites, your use of the service, your violation of these Terms, your violation of law, or your violation of third-party rights.

17. Changes

Embeditor may update these Terms from time to time. If changes are material, we will provide notice where required. Continued use of the service after the updated Terms take effect means you accept the updated Terms.

18. Governing law and disputes

Before publishing, Embeditor should insert governing law, venue, arbitration or court process, class-action waiver if desired, and any region-specific consumer rights carve-outs. Until then, disputes should be handled under the law and venue stated in the applicable order form or written agreement, if any.
